Last September New York Attorney General, Eric Schneiderman, insisted current state law leaves the abortion door open through all nine months of pregnancy. Yet now he is promoting radical abortion expansion legislation which he contends merely codifies Federal law.
This raises three questions:
- Since the Supreme Court rulings of 1973 conceded a state’s right to place restrictions on abortion, how would total deregulation of abortion serve to make NY law more consistent?
- Schneiderman already reads existing NY State law as permitting abortion at any time. Can more legislation fill a cup already full?
- If the role of Attorney General is to enforce existing law, is it appropriate for him to use his position to lobby for new ones?
