On December 10th, the U.S. Supreme Court rejected President Joe Biden’s request to block Texas’ abortion ban, again. This is the second time the Court heard an emergency appeal from the Biden Justice Department to strike a Texas abortion ban after a pre-born baby’s heart is detectable, approximately six weeks gestation. At that early stage most women do not even know they are pregnant. Further, in order to perform an abortion, an abortionist must confirm a viable pregnancy. This is done by detecting a fetal heartbeat. So effectively, Texas banned all abortions. However, while the court refused to block the Texas ban, they did allow for the lawsuits to continue through the lower court system. An early study on the impact of law on the Texas abortion industry reveals abortion has been cut by at least 50%.
